Terms and Conditions
1) ACCEPTANCE OF ORDERS
All orders for our generators are subject to stock availability, prior sale of any goods quoted on or listed in any catalogue or
price list. No agent or company representative may commit Maverick Generators to any variation to these conditions.
2) PRICE VARIATION
All prices quoted are subject to variation depending on any unforeseen factors that may affect the following:
2.1) Prices ruling at the date of the dispatch of the goods from country of origin.
2.2) The rates of Ocean Freights, Insurances, Customs Duties, Import Duties, Railage and Rates of Exchange ruling at the date of
delivery.
3) ORDERS
3.1) Where orders have been placed, and a retaining deposit as agreed to has been paid by the Customer, the signed order
agreement will constitute a legally binding purchase agreement between both parties.
3.2) Whereas Maverick Generators are bound to supply the Goods as specified in the order (Clause 1, 2, 3,4 and 5 apply), or
refund the deposit amount in full if Maverick Generators fails to honor the agreement by delivering the Goods as agreed, the
Customer is bound to collect and settle the outstanding amount on the Goods within 7 days of them being made available to
the Customer for collection. Should the Customer fail to collect the Order within the time period stipulated,
Maverick Generators reserves the right to sell such Goods to a 3rd party and the Customer will lose all claims to the deposit as
paid.
3.3) We will not accept any Orders without a deposit, an Order will only be considered valid once the deposit as agreed
upon has been deposited into Maverick Generators bank accounts.
4) DELIVERY
Maverick Generators or Associated Companies shall not be held liable in any way for any delay in delivery dates stipulated
which may be due to any circumstances beyond their control.
5) DRAWINGS / SPECIFICATIONS
5.1) Drawings, descriptive matter, weights, dimensions and specifications appearing in any documents emanating from this
company are approximate only and are subject to modifications without notice.
5.2) Where goods are supplied to the specification or drawings or details supplied by a Purchaser/Customer, Maverick
Generators or its suppliers will not be responsible for the efficient working of those goods or the fitness of those goods for the
purpose for which they are supplied whether same purpose is known to Maverick Generators or not.
6) PERFORMANCE
All performance figures are approximate only and Maverick Generators shall be under no liability whatsoever in respect of
failure to obtain such figures. Variables such as altitude, quality of fuels and environment in which these generators are used
can affect performance thereof.
7) EXCLUSION OF WARRANTIES
Save to the extent provided in the Guarantee/Warranty herein set out, Maverick Generators gives no guarantee nor warranties,
express or implied, nor makes any representations of any nature whatsoever in respect of the materials utilized in
manufacturing of the goods supplied or installed, nor as to the fitness of any such goods, installations or repairs for any purpose
for which they are required whether such purpose be communicated to Maverick Generators or not. The sole liability of
Maverick Generators shall be as provided for by the terms of the Guarantee/Warranty as set out which shall be deemed to be
incorporated in the Conditions of Sale.
8) LIMITATIONS OF LIABILITY
8.1) Maverick Generators or any of it's employees or directors shall not be liable for any contingent damage or losses under any
circumstances whatsoever, for loss of profit or damages, direct or indirect, consequential or otherwise, which may be sustained
by the Purchaser/Customer as a result directly or indirectly of:
8.2) goods supplied by the company being defective
8.3) goods repaired by the company being defective due to defective workmanship or materials.
8.4) any delay in delivery of any goods by Maverick Generators.
8.5) any delay in effecting any repairs
8.6) any faulty or incorrect installations made by our approved installer and any damages as a result thereof.
8.7) the failure by Maverick Generators to deliver any goods or in respect of any deliveries of goods by Maverick Generators
which may be incorrect or which result from riots, acts of God, fire, strike, civil commotion, labor dispute, accident, delay in
manufacture or transportation, shortage of fuel, material or labor or any act, demand or requirement of any State or
Government or any other authority, or any cause whatsoever which is directly or indirectly or entirely or partly beyond the
control of the Company
b) Should Maverick Generators supply goods or parts or do work free of charge in excess of its obligations under these
Conditions of Sale, Maverick Generators shall be under no liability whatsoever if such goods or parts prove in any way to be
defective.
9) GUARANTEE / WARRANTY
9.1) Unless goods sold on an 'as inspected' or 'voetstoets' basis, or as otherwise confirmed in writing, a period of Twelve
Months guarantee from date of sale* will be applicable, or 1000 hours of operation in case of models fitted with a time
counter, whichever transpires first, covering defective materials, on the basis that any of the said goods requiring attention
under guarantee are returned to or attended to by our approved repair workshop as may be stipulated by Maverick
Generators. Any expenses (including the cost of any insurance of the goods) involved in the removal or replacement or carriage
from and to the Purchaser/Customer of such goods or any part thereof will be for the Purchasers/Customers account. (*Date of
sale being date at which goods initially leave our stores)
9.2) This guarantee shall not apply to:
9.3) Any accessories or proprietary fittings whatsoever.
9.4) Any goods used for any purposes whatsoever other than the genuine use for which goods were supplied.
9.5) Any defective part or parts which in the opinion of Maverick Generators and their servicing agents has or have been injured
by wear and tear or by the use of oils or fuels not recommended by Maverick Generators or the approved servicing agents or by
any other form whatsoever or improper use of or from any alteration whatsoever to the goods not done by our installing and
servicing agent.
9.6) Any goods that have been altered, repaired or serviced by 3rd parties other than our approved servicing, repair and
installing agents, in any manner which, in the opinion of Maverick Generators, has caused the alleged defect, will not be
covered.
9.7) Use of spare parts other than those recommended by Maverick Generators and the approved servicing agents will waiver
the warranty in full.
9.8) Any claim under this Guarantee will not be entertained unless the claimant:
9.9) lodges his claim to Maverick Generators approved service agents within seven (7) days after the alleged defect in question
has become apparent.
9.10) at the same time, submits full particulars of the claim and of the reasons therefore stating in such particulars the date of
purchase and full relevant particulars, including original invoice No. and serial numbers of relative products.
9.12) The guarantee/warranty is only valid when all terms and conditions, as laid down by the Manufacturer of said goods in
writing, have been fulfilled.
9.13) THE WARRANTY AS LAID OUT BY THE MANUFACTURER IN WRITING, WILL ONLY REMAIN EFFECTIVE IF THE GENERATORS
ARE INSTALLED, SERVICED AND MAINTAINED BY OUR APPROVED SERVICE AND INSTALLATION AGENT.
ANY INSTALLATION OR SERVICING OR REPAIRS CARRIED OUT BY NON-APPROVED 3rd PARTIES WILL RESULT IN THE WARRANTY
BEING WAIVERED IN FULL. ANY FAILURES OF OUR EQUIPMENT DUE TO THE ABOVE WILL NOT BE HONOURED UNDER OUR
WARRANTY.
10) The Term "Maverick Generators" means Maverick Trading 1225 CC Reg number 2007/049254/23 T/A Maverick
Generators, and includes all employees, agents, distributors, directors, servicing agents and shareholders of said company.
